Total Control Software Terms of Service

Welcome to Total Control Software ("TCS," "Company," "we," "us," or "our"). These Terms of Service ("Terms") govern access to and use of Total Control Software applications, websites, TCSEmail, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms.
If you use the Service on behalf of a business or other entity, you represent that you are authorized to do so. You are responsible for maintaining the confidentiality and security of credentials and connected accounts used with the Service.
Subject to these Terms and applicable customer agreements, TCS grants authorized users a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to use the Service for legitimate business purposes.
You agree not to reverse engineer or improperly copy the Service; use it for unlawful, fraudulent, abusive, or malicious activity; interfere with its security or operation; or access data or systems without authorization.
TCSEmail is an email integration provided by Total Control Software. It allows an authorized user to connect a Google account and send email through that account from Total Control Software. Use of TCSEmail is optional and requires the user to authorize the Google permissions requested by TCSEmail.
· User Authorization: You are responsible for connecting only a Google account that you are authorized to use and for reviewing the permissions presented during Google’s authorization process.
· Purpose of Access: TCSEmail uses Google authorization and Google API access only to provide the user-facing email functionality requested by the authorized user.
· User Control: You may revoke TCSEmail’s access through your Google Account permissions. Revocation may disable TCSEmail functionality until authorization is granted again.
· Google Terms: Your use of Google services remains subject to Google’s applicable terms, policies, and account controls. TCS is not Google and does not control the availability or operation of Google services.
· Limited Use: TCSEmail’s use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
· AI/ML Restriction: Google Workspace API data accessed through TCSEmail is not used to develop, improve, or train generalized or non-personalized artificial intelligence or machine-learning models.
Fees, support services, renewals, modules, and other commercial terms may be governed by separate quotes, invoices, license agreements, support agreements, or other customer agreements with TCS. If a separate written agreement conflicts with these Terms regarding a specific paid service, the applicable written agreement controls for that service.
Customers and users retain their rights in data and content they provide through the Service. TCS may process such data as reasonably necessary to provide, maintain, secure, and support the Service. The Service, software code, interfaces, documentation, trademarks, and other TCS intellectual property remain the property of Total Control Software and its licensors.
Our Privacy Policy explains how TCS collects, uses, stores, protects, and discloses personal information, including information associated with TCSEmail and Google API authorization. The Privacy Policy is incorporated into these Terms by reference. TCSEmail will access and use Google user data only as described in the Privacy Policy and as authorized by the user.
You may stop using the Service at any time, subject to applicable customer agreements. TCS may suspend or terminate access when reasonably necessary to address a violation of these Terms, protect the Service or other users, comply with law, or address security risks. Revoking Google authorization terminates TCSEmail’s authorized access to the applicable Google account but does not necessarily terminate other TCS services.
Certain Service features may interoperate with third-party services, including Google. Third-party services are governed by their own terms and policies. TCS is not responsible for changes, interruptions, or discontinuation of third-party services outside TCS’s control.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TCS DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED IN A WRITTEN CUSTOMER AGREEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TCS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICE.
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles, except to the extent another governing-law provision applies under a separate written agreement.
We may update these Terms from time to time. The current version will identify its Last Updated date. Continued use of the Service after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.
